Employment Tribunal Fees Deemed Unlawful

By charging fees for an employee to bring an employment tribunal against their employer. Unison took the case to the Supreme Court with their argument that the fees prevented workers, especially those on low incomes, from getting the justice they deserve as they could not afford to bring their case to court.

The Supreme Court had noted that since the fees were introduced, there had been a significant fall in claims being brought and therefore, the fees were the barrier to an employee obtaining justice.

It is likely that, now there are no fees applicable to bringing a tribunal to court, more claims of this ilk will arise whether genuine or not. This would mean you may face legal fees and possibly awards payments if a claim was to be brought.
